Five persons including the Olusongbe of Songe land,Oba Adepoju Hassan,65, Mufutau Oyeweso,56, Adebiyi Mukaila,45, Oyeweso Abiodun,37,Azeez Akanmu,71, were on Monday arraigned before a magistrate court sitting in Osogbo for threat of life and breach of peace.
The accuse persons were said to have caused breach of peace by going to Egbedi with thugs,cutlass and stick,and in the process threatened the life of one Azeez Muideen and Ayandiran Rasheed.
According to the charge, the offence was committed on the October 13,2019 around 10am at Egbedi Area.
The offences were contrary and punishable under sections 516,86 and 249(d) of the criminal code cap 34 vol 2 laws of Osun State of Nigeria 2002.
The five accuse persons who were arraigned on 3-count bothering on conspiracy,breach of peace and threat of life pleaded not guilty.
The Defence Counsel,Mr Taofeek Ibikunle applied for bail in the most liberal terms.
He said, the first accuse(Adepoju Hassan)is the Oba of Songbe land in Egbedore Local Government,why the 2nd and 5th accused are members of the King’s cabinet.
The Prosecutor, Inspector Elisha Olusegun objected the bail application on the ground that the accuse persons may spark reasonable peaceful activities in the community and may also jump bail.
He said, there is a pending case which touches on the same matter but different parties in Osogbo Magistrate court 3, the accuse persons were invited to the police station when the case was still pending, but they refused to show up.
Magistrate Risikat Olayemi in her earlier ruling said,it is clear that there is a pending case in Osogbo Magistrate court 3, which touches on the same matter but different parties.Each of the five accused is to be granted bail by the police.
She ordered the accused to answer the police whenever they call for them and report at Osogbo Magistrate court 3 on October 16,2019.Peace should be maintained in the community.
The Defence Counsel pleaded that the accused should be released to him based on self recognition, because they have been in Police detention since yesterday.
He promised to make sure that the accused appear before court 3 on October 16,2019.
Magistrate Risikat Olayemi finally ruled that,on the application of the defence counsel, the earlier order is reversed on the condition that a written undertaking should be wrote to the court and a copy of it must be given to the prosecutor.
She said, the five accused are to be released to their counsel.
The case was transferred to Osogbo Magistrate court 3 and adjourned till October 16,2019.
