Osun Magistrate Court sitting in Osogbo has remanded those that allegedly blackmailed Majority Leader of the Osun State House of Assembly , Mr Timothy Owoeye, by releasing a video showing him without clothes, till 24th October.
Upon the fresh arraignment, the former charge raises against the accused, was substituted with seven count of Kidnapping, armed robbery, conspiracy, possession of unlawful firearms and others by the State Chief State Counsel, Mr. Moses Faremi.
According to the new charge, it read, “That you Kazeem Agbabiaka, Femi Oyebode, AbdulRasheed Ojonla, Babatunde Oluajo, Adebiyi Kehinde, Oseni Oyebanji, Oyeniyi Ismaila, Azeez Awodunmola, Kehinde and others at large between the month of April and July 2018 at Oluajo area Osogbo in the Osogbo Magistrates district did conspire among yourself to committe a felony to wit;armed robbery there by committee’s an offence contray to section 6 (b) and punishable under section 1 (2)(a) of the robbery and fire arms (special provisions)act 2004.
“That you armed with dangerous weapon like guns UTC axe and cutlass did rob one Timothy owoeye of the sum of 38million naira there by committed an contray to and punishable under section 1 (2)(a) of the robbery and fit arm special provisions act 2004.
“That you were found to be in possession of UTC axe locally made guns and cutlasses and there by committed an offence contrary to Section 3 and punishable under section 27 (1)(a)(i) & (iv) of the firearms 2004.
“That you did conspire among yourself to committe felony to wit obtaining money under false pretence and there by committed an offence contrary to section8 (a)and punishable under section 1 (1) (a)&(3)of the advance free fraud and other related offences act 2006.
“That you did with an intent to defraud one Timothy Owoeye obtain by false pretense the sum N38 million under the pretense of organising spiritual for him to avert death and hereby committed an offense to Section 1 (1) (A) (B) and punishable under Section 1 (3) of the Advance Fee Fraud and other related Offences Act, 2006.
“That you did conspire among yourselves to commit a felony to wit: kidnapping thereby committed an offence contrary to Section 516 of the criminal Code Cap 34 Vol. II laws of Osun State, 2002
“That you did kidnap one Timothy Owoeye and thereby committed an offence contrary to and punishable under Section 364 (2) of the criminal code cap 34 Vol. II Laws of Osun State 2002.
The pleas of all the accused person were not taken by the Magistrate, Mr. Segun Ayilara.
The defense counsel, Mr. Kazeem Badmus argued that Magistrate court lacked jurisdiction on the matter.
Responding to the argument, Mr Moses Faremi prayed the court to discountenance the plea of the defense counsel.
The Magistrate, Mr. Segun Ayilara adjourned the case to 24 October 2018 pending the ruling on jurisdiction as he ordered that the eight accused persons be remanded prison.
